Since April 6, 2022, no fault is required to begin divorce proceedings in England and Wales. This means neither party needs to prove blame (such as adultery, unreasonable behaviour, or separation). The change was introduced to reduce conflict, remove adversarial elements, and simplify the process.
What Changed Under No-Fault Divorce?
- No blame, no fault – you don’t need to allege misconduct or waiting periods.
- Joint applications allowed – both partners can apply together, reducing tension.
- Clearer timelines and procedural steps, less opportunity for delays.

How the No-Fault Divorce Process Works
1. Apply for Divorce
You submit a divorce application (sole or joint) to the court. Basic information about marriage and intention to dissolve the marriage is required.
2. Conditional Order
The court reviews your application and documents, then issues a Conditional Order if everything is in order. This used to be called a Decree Nisi.
3. Final Order
You apply for the Final Order (formerly Decree Absolute) after a waiting period. Once granted, your marriage is legally ended.
4. Related Arrangements
During or after the divorce, issues like finances, child arrangements, and property settlements are resolved via consent orders, hearings, or mediation.
