Marriage Annulment in England & Wales

Clear, affordable support for individuals seeking to annul their marriage through the UK courts — expert guidance every step of the way.

Marriage annulment is a legal process that declares a marriage null and void — as though it never legally existed. It differs from divorce, which ends a valid marriage. You can apply for an annulment if your marriage was never legally valid or if it is considered voidable under specific circumstances.

At The McKenzie Friend, we support individuals who wish to apply for an annulment, helping you understand eligibility, gather evidence, and prepare your court application with care and precision.

When Can You Apply for a Marriage Annulment?

You can apply for an annulment in England and Wales at any time after the wedding — unlike divorce, which usually requires at least one year of marriage.

A marriage may be:

  • Void — The marriage was never legally valid from the start. This applies if:
    • One or both parties were under 16 years old.
    • Either person was already married or in a civil partnership.
    • The ceremony didn’t meet the legal formalities for marriage in the UK.
    • The couple are closely related.
  • Voidable — The marriage was legally valid but can be annulled because:
    • It was not consummated (sexual relations did not take place).
    • One party did not consent (due to duress, mistake, or mental incapacity).
    • One party had a sexually transmitted disease at the time of marriage.
    • The other person was pregnant by someone else at the time of marriage.

The Annulment Process Explained

1. Submit a Nullity Petition

You begin the process by completing a nullity petition form (D8N) and submitting it to the Family Court. This sets out your reasons for seeking annulment.

2. Acknowledgment of Service

The other party will receive a copy of your petition and is asked to confirm whether they agree or wish to contest the annulment.

3. Conditional Order (Decree Nisi)

If the court accepts your grounds, it issues a conditional order (previously known as a Decree Nisi). This confirms that the court sees no reason to deny your application.

4. Final Order (Decree Absolute)

After a short waiting period, you can apply for a final order (Decree Absolute), which officially annuls the marriage and ends its legal existence.

Key Considerations

  • Even if your marriage is annulled, the court can still decide on financial or property matters, just as it would during divorce.
  • Annulment applications can be more complex than divorce, especially if the marriage is being contested or if evidence is limited.
  • There’s no minimum marriage duration required before applying.

Our McKenzie Friends provide professional, structured guidance to ensure your petition is presented clearly, supported by evidence, and handled with sensitivity.
